This privacy notice (the “Privacy Notice” or the “Notice”) explains how Tierras Vivas E.I.R.L., its affiliates, and subsidiaries (“Tierras Vivas,” “we,” “us,” “our”) process and handle personal information when you book a tour with us, inquire about booking a tour, visit our website, or use any related products or services.

Tierras Vivas takes your privacy seriously, and we are committed to protecting your personal data. We follow the practices described in this Notice and treat your personal information in accordance with applicable laws in the places where we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices, or regions. Any such additional notices should be read in conjunction with this Notice.

If we make changes, we will update the date at the end of this policy and, in some cases, provide you with additional notice (such as adding a statement to our website or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

 

What Personal Information We Collect

When you book a tour or inquire about booking a tour with us: We collect various pieces of personal information when you inquire about booking one of our tours. This information may be collected via our website, our app, through a third-party travel agent, or by speaking with one of our sales agents. Depending on the services you’re inquiring about, we typically collect the following:

  • Your first and last name, phone number, address, email address, and date of birth.

Once you have booked a tour, we may require additional personal information as part of a process we call “Best Operator.” This is necessary to verify your identity, assess the suitability of the selected tour, provide notices and updates about your tour, and process your payment. The information required for the ‘Best Operator’ process includes:

  • Gender, next of kin, travel insurance details, residency, emergency contact information, ISIC information (if applicable), payment information, dietary preferences, passport details (including, where applicable, a scanned copy of your passport), information required for visa applications, and
  • Health and medical information such as pre-existing medical conditions, vaccination status, and special medication requirements that may impact your ability to safely participate in the tour.

We may also collect the personal information of co-travelers whose information you provide during the booking process. By providing us with personal information about others, you certify that you have permission to do so for the purposes described in this Notice and that they have read and understood how it applies to them.

When you contact us: If you contact us by phone or email to inquire about purchasing a tour, ask questions, or resolve an issue, that call may be recorded and/or monitored for quality control, training, and customer service purposes. We may collect information such as the identity of the caller/email sender, the date and time of the contact, and the subject matter.

When you visit our website: When you visit the Tierras Vivas website, we may collect various data points, some of which may be considered personal information. This information may include:

  • Usage Information: Pages or content you view, searches for tours, bookings made, and other actions on our website.
  • Payment Transaction Information: Payment method used, date and time, payment amount, payment method expiration date, address, and other related transaction details.


Photos and videos taken while traveling on a tour: While on a tour, photos or videos may be taken by other travelers or our tour guides that may include you or your likeness, which may constitute personal information. Any photos or videos taken by a tour guide or our representatives will not be used for marketing purposes without your prior knowledge and permission. We handle and collect your personal information carefully, but we are not responsible for other travelers on your tour who may take your photo without your permission.

Occasionally, a professional photographer may be scheduled on your tour for the purpose of taking pictures and videos to be used for promotional purposes. In such instances, we will present you with a consent and waiver form that you will have the option to accept or decline before your tour departs.

When you apply for a job with us: If you apply for a job with us, we will collect personal information such as your name and contact information, your employment history, and other personal information that may be reasonably required to verify your identity and evaluate your suitability for the job you have applied for.

 

How Do We Use Your Personal Information?

We collect, hold, and use your personal information (subject to the selections you make and applicable laws) for a variety of business purposes, primarily to provide, improve, customize, support, and market tours and any related services we may provide to you. These purposes include:

To provide, improve, and develop our tours and related services: Our primary use of your personal information is to arrange and provide the tours you have booked and any associated services. Examples of how we use your personal information include:

  • Enabling the presentation of booking information in your account on our Tierras Vivas website.
  • Creating a personal identifier for booking services (CODE BOOKING) to distinguish you from other customers.
  • Creating a personal identifier for chat functionality and notifications.
  • Providing our staff with the information required to operate Tierras Vivas services you have booked.
  • Performing analytics and debugging our technology (e.g., our Tierras Vivas website) to ensure it operates as intended and without interruption.
  • Sending you messages, updates, security alerts, and account notifications about any tour or connected services you have requested.
  • Providing you with ongoing service and support, including assisting with any issues you may experience.


To comply with our legal obligations and manage our business: In certain limited instances, Tierras Vivas may be required to use your personal information to comply with legal obligations, such as tax requirements (SUNAT). We may also use your personal information to conduct internal business administration, such as carrying out internal accounting.

To provide, personalize, measure, and improve our advertising and marketing: Tierras Vivas also uses your personal information to inform you about our tours, special offers, and related products and services. Marketing purposes include:

  • Sending you promotional messages, marketing, advertising, and other information based on your preferences, including social media advertising.
  • Personalizing, measuring, and improving our advertising.

Promotions for these products and services may be offered by us or our brand partners.

How Do We Share Your Personal Information?

There are a few different circumstances where we may share your personal information with a third party. We take great care to ensure that our business partners and third parties with whom your information may be shared treat it with the same degree of care and attention that we do. We will not sell, distribute, or otherwise share your personal information unless we (i) have your permission and consent, or (ii) are required or permitted by law to do so.   • On-Tour Service Providers: We share personal information with affiliated and unaffiliated service providers to help us run our business and provide you with the services you request. This includes service providers that help us: (i) provide accommodations, (ii) provide transportation, (iii) provide activities on the tour, and (iv) sell tours and confirm the services you have requested (e.g., travel agencies and our branded partners). We share your information internally with employees who need to know it and with our Webmaster department. These providers are contractually bound to keep personal information confidential, secure, and to use it only for the purposes for which we disclose it to them. In some cases, we may share your personal information with government authorities (e.g., for border crossings and visa requirements).
  • Local Operator and Webmaster: We also use a range of third parties to help us operate, provide, improve, customize, and market our tours and services. These include Webmaster departments that provide information about our website, maintenance, backup, storage, payment processing, and other related services. Additionally, we work with a network of partners (both affiliated and unaffiliated) who help us market and promote our tours, send marketing materials on our behalf, generate leads, and resell our services.

Service providers and business partners that process personal information on our behalf do so for our purposes only and must agree to certain privacy obligations in their contracts with us. These include complying with privacy laws, safeguarding personal information, and only processing that information under our direction for permitted purposes.

Your Rights

You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. A more detailed description of these rights is as follows:

Children’s Privacy

Our services are not directed at children under the age of 16, and we do not knowingly collect personal information from children under the age of 16 without obtaining the consent of the parent or guardian.

Tierras Vivas operates South America, and we may transfer your personal information to countries other than the country in which it was collected. These countries may not have the same data protection laws as the country where you initially provided the information.
